The Demise of the 28-Clause Peace Initiative for Ukraine: Why Diplomatic Efforts Continue to Stumble

Europe breathed a deep collective sigh of relief on Monday, as the diplomatic emergency triggered by the presentation of a new comprehensive peace framework for ending the war appeared – temporarily – to have been stabilised. A Washington representative spoke of "substantial progress" after bilateral negotiations in Geneva. On Monday night, Russian leadership made its retaliation: another massive barrage of missile and drone strikes on Kyiv.

The Rhythm of Negotiation and Warfare

The chain of contrasting events captured the harsh reality of the current period. By day, diplomatic battles are waged: optimistic declarations are released from different nations. Significant resources is allocated on managing certain initiatives. By night, the Kremlin clearly shows the world that, for them, military action persists as the key method for achieving "resolution".

Nocturnal Warfare

As the offensive unfolded into the early hours of Tuesday, the current condition of Ukraine's defenselessness was laid bare. Ukraine is able to track rocket firings from Russian territory, a ability provided through timely intelligence. From vantage locations, Ukrainian air force fighter jets that had been dispatched to counter approaching guided weapons streaked across the sky – sophisticated military planes provided to Ukraine by NATO members.

Shortly after, Kyiv's anti-aircraft weapons thundered: defensive missiles fired to intercept a Russian ballistic missile. This was a modern interception technology at work, most likely supplied through allied countries. Every firing creates sudden vibrations, shaking the windows. The instant of fear quickly becomes sober acceptance: perhaps the approaching threat won't strike its target this time, preventing destruction from devastation and additional electricity failures.

Continuous Dangers

Soon after, a heavy machine gun opened up on a unmanned aircraft in the vicinity, part of a defensive team – almost certainly allied-provided weaponry. Unfortunately, the projectiles didn't strike the enemy aircraft – it pressed on overhead toward its objective.

With pauses, this carried on until dawn. Kyiv greeted the daybreak reports: multiple fatalities, devastation and utility failures in many homes as a result of the night's assault. As customarily, everyone still went about their day – enduring hostilities. But those full day illustrated Ukraine's vital need on international aid – a reliance that neighboring countries are demonstrably unable to fill in the immediate future.

Ineffective Peace Efforts

The comprehensive proposal from Washington generated strong feelings, debate and profound anxiety – and momentarily shifted focus from Ukraine's most significant graft case in years. Yet, we have seen this script before, after prior negotiation attempts and international summits.

Every new approach from Washington follows the same pattern: a negotiation push against Ukraine, which Kyiv, with partner nations, succeeds in resisting. They stabilise the situation but never actually achieve victory. This trend will, undoubtedly, continue.

Political Considerations

It is convenient to criticize particular leaders of consistently pushing Russian terms. But that does not seem to be the whole story. US administration functions according to a principle well known to seasoned negotiators: you cannot win at the negotiating table what you have failed to defend militarily. The White House believes that it is unrealistic to compel Moscow to abandon the areas that it currently occupies in Ukraine's south or east.

The issue is that while acknowledging this situation, American administration does nothing to discourage Russia, through diplomacy or military means, from assuming that the situation will not change more in its benefit in the near future.

Opposing Positions

Therefore, Russian leadership is convinced that time is on his side – that Ukraine and its partners are coming close to fatigue. Their incentive to agree to terms that does not give them the maximum possible gain is close to zero. There may be many attempts to stop fighting, but they will persist as long as Russia's government remains highly assured in the result.

On the contrary, Ukraine's government believes that Ukraine can still hold out, gradually sacrificing civilians and areas but averting a total frontline collapse until conditions improve in its benefit.

Existing Situation

Factually, there are no actual prerequisites for a truce. Now, personal considerations are becoming relevant: leadership ambitions to broker a ceasefire and obtain worldwide acknowledgment, and Kyiv's double obstacles – on one hand, not to alienate a key ally, and on the other, to unite the population around the country's interests against any initiative Kyiv finds unsuitable, so that their focus does not move to internal issues. And although their mission will now be significantly challenging after recent developments, it remains highly unlikely that this will change their overall approach.

These two forces are guiding negotiations.

Conclusion and Outlook

It took a mere seven days to eliminate the suggested clauses of the current initiative. Forceful and unpredictable management of the matter by American leadership, resistance by Ukraine and the rest of Europe, along with pacifying measures of representatives, and finally, current information leaks, all achieved their purpose.

While new proposals based on established approaches are imminent, Kyiv, London and other allied nations should reach an essential realization: Ukraine and Europe will only be able to counter diplomatic offensives from Washington that are based on Russian demands and demonstrate particular unwillingness to modify developments, if they maintain solidarity and enhance their military capacity at a significantly accelerated rate. If they do, no combination of diplomatic or military actions will be able to defeat them. In the meantime, Ukraine's ability to counter nocturnal attacks will, for the coming months, primarily depend on ongoing international assistance.
